Law Enforcement Case Screening Requests
Important information for law enforcement agencies regarding pre-charge screening and case re-evaluation requests.
These forms are for law enforcement agencies within the First Judicial District only. Members of the public cannot submit screening requests or referral forms.
Axon Is Not a Case Referral System
- Uploading reports, videos, photographs, or other evidence to Axon does not initiate a case.
When to Use the Major Crimes Pre-Charge Screening Request Form
- Use only for pre-charge review of Homicide investigations, First-Degree Child Abuse (Great Bodily Harm) investigations, and Sexual Assault investigations.
- No other case types qualify for pre-charge screening using this form.
- Submit the completed form to LEAscreeningrequest@da.state.nm.us .
When to Use the Re-Evaluation Form
- Use only when a felony case was previously charged by LEA and the FJDA formally declined the case for prosecution (DE). Once the issues are cured, the LEA may seek reconsideration based on new or additional information.
- Submit the completed form to LEAscreeningrequest@da.state.nm.us .
Important Limitations
- The re-evaluation form applies only to cases that received a formal Declination for Prosecution (DE).
- It cannot be used for PHX dismissals, new case referrals, supplemental reports without a declination, or requests submitted only through Axon.
Cases That Do Not Qualify
- Routine felony investigations that are not homicide, first-degree child abuse (GBH), or sexual assault cases.
- Misdemeanor (MR) cases subject to the separate MR review process.
- General requests for legal advice or consultation.
- Cases submitted only through Axon or another evidence-sharing platform.
- Incomplete Referral Forms.
Other Ways Cases Are Initiated
- By filing a criminal charging document in Magistrate Court.
- By submitting an eligible major crimes case through the Major Crimes Pre-Charge Screening Request Form.
- Through the established MR review process for qualifying misdemeanor cases.
